    Query on counterfeit items rules
                     

    Hi, I listed an item, mobile phone grip and it was removed as supposedly infringed copyright rules.  I understand pop sockets have the name owned under this law, but I did not use that anywhere in my listing.  I made the items from resin myself at home to sell and sold one item already and despatched no issues.  It has now been removed and I don’t understand why.  I have queried with eBay and all I got back is a message on how to list items, rude seen as I have listed over 1000 items and know what I am doing.  Also a copy of copyright rules, which I feel I have followed fine.  Any ideas on what I can do, I want to make and sell more of these items, but don’t want to get negative history with items that keep being removed.  Any help or advise welcome thx

    You do not seem to understand that a copyright does not only cover a brand's name, but also the product design. So if you made one yourself from a Popsockets original, you did violate their copyright.

     

      If you also used an image from a movie, card game, comic/cartoon character, or any copy righted image or symbol, on your home made grip. You may have violated that copyright.  Popsockets, has to obtain and pay for the licensing  right, to use those images on their grips. So the copyright infringement may be for an image you used, not for the grip itself. 

     

    FYI.  You are located in the U.K. but have posted your query on the U.S. based site (ebay.com)  You may want to make sure you post issues on your home site (ebay.co.uk) in the future.

    Thanks for your reply, the item was made from a Mold bought in the uk, widely sold on many sites, made in resin with a plastic back attached with sticky pad, also came with Mold set, I had no pictures or images on it, it was just pink holographic in colour/design.  Does that mean I cannot make this product at all and sell it as a phone grip? Lots people selling them on eBay already, was careful not to use the word pop socket anywhere, thx for the advise.
