Purchased item that never arrived

I bought an item on 9-10-26. My card was charged and I haven't heard one word from the seller. 10 days after buying, I sent the seller a message asking if I could get tracking information. Never heard back. On 9-21-26, I sent a cancellation request. Ebay tells you that the seller has 3 days to respond to that request. So I wait 3 days. Today, I get an email that my cancellation request is denied, but I still have no idea where my item is and if it's even coming. Ebay's system does not allow you to get anywhere but in circles, when using their automated help system. Not a human to be found. At this point, I'm calling theft, but what recourse do I actually have?

Mentor2 weeks agoGo to your Purchase History and click on Order Details next to the item title to see if the latest estimated date of delivery has already passed.
IF/WHEN the latest estimated date of delivery has already passed by at least 1 day, you have up to 30 days past estimated date of delivery to file a Refund Request:
Go to your My Ebay page >> Purchase history
· Select “More actions” beside your item and then “I didn't receive it.”
· Click the box beside I want a refund.
· Select Send request.
If the seller does not respond to the refund request, after 3 business days you can ask Ebay to step in to help you.
· Find the item in your Purchase History
· Select See request details
· Select “Ask eBay to step in.”
