Purchased a fake item tried to cancel before shipping

I purchased a pair of oakly only to find they are NOT authentic, and tried to cancel, but seller refused my cancellation, but has not shipped yet. what can I do?

The buyer can request a cancellation, but the seller does not have to cancel just because the buyer requests it. Many sellers would voluntarily cancel if the item has not shipped (or would be wise to do so), but if the seller is a scammer the scammer will not cooperate.

If the seller does not ship and there is no tracking showing delivery, you can file an "item not received" case the day after the last estimated delivery date and ask eBay to step in to force a refund.

If you receive an item that does not match the description, file a "not as described" return within thirty days and return the item at the seller's expense. The process is automated; if the seller does not cooperate at any point, ask eBay to step in after three business days.
