I just received an item advertised as NEW who obviously was used , it is a tool so instead of going trough the trouble of return it I decide to keep it , but let Ebay knows what happen, their response , “we didn’t found any violations of our policies†So buyer beware , not every sellers are honest and this platform may not always be correct.

If you are not willing to take the trouble to return an item, eBay assumes you are not unhappy with it.
Reporting a listing for a policy violation may cause an examination of the listing, but eBay cannot examine the item, so unless there is a policy violation in the listing itself -- not a difference between the listing and the actual item which eBay never sees -- then no violation is likely to be found.
