possible spam or fake accounts, same used item listed by two different sellers

Question

Can you/someone sell an item not in their possession? Searching for some shoes, found this used shoe and it clearly is the same (you can look at the photos of the sole where it is dirty and see that it's the same). Seems fishy, nervous about accepting a buy it now offer.....

One seller may have used another seller's photos, which is allowable by eBay standards even if it's not best practice, but it doesn't specifically mean they are trying to sell the exact same pair. They simply felt those photos were adequately representative of the item, I suppose.
