I purchased an item from a seller, that has mistakenly shipped my item to a buyer in North Carolina and vice versa. The NC buyer refuses to mail me my item, after I mailed his item to him in good faith and out of my own pocket. After paying a tariff for an international delivery, the NC customer acknowledged that he had my item and sent me a Pic of it. The other buyer and seller are now locked in a dispute and the buyer refuses to mail my item, and insists on sending it back to Germany. Long story short, the seller has my money, the other buyer has my item, and I have nothing. A claim has already been filed with Ebay and the police in NC has been advised. I'm fed up. What else should I do?

Keep copies of all of your correspondence, in the end you may have to file a dispute with your funding source to get your money back.
Are you actually in direct contact with the Buyer who has YOUR item or is all the correspondence with you coming from the Seller (in Germany right?).

OP5 months agoYes, I have his phone number and address. When prompted to when I would receive my item, he told me to refer everything to Ebay even after I sent him his item out of good faith. He's now holding my item hostage over a dispute with the seller. I retained every text message I have with the other buyer

Ugh, I am sorry the seller made a mistake and the other buyer is uncooperative.
What sort of case did you open on eBay? An item not received case or a Return Request?

OP5 months agoI opened an item not received case. The seller is being cooperative but the other buyer (who by the way said that he also an Ebay seller) is making this whole thing difficult for no reason. If I find out the other buyer's Ebay handle, it may not be a good day for him.

If you opened an Item Not Received Case, it is going to close with no refund, UNLESS your seller just sends you a refund now.
The case will close automatically if the seller does nothing because there is tracking for a delivery on the case.
Please ask the seller to refund you through the case now.

OP5 months agoI had no choice but to leave a less than favorable feedback about the seller. Needless to say that he wasn't pleased, and even went as far as telling me that I ruined his day because today is his birthday. We'll, be that as it may but I'm the one who gave you $188 for a product that I don't have, and it's been a month . He's telling me to remove the negative feedback but I'm standing firm until I get my product or my money. I explained to him that the feedback wasn't personal, but you'd do the same thing if the roles were reversed
