Petition to litigate Ebay!
I am going to have a petition filed to litigate Ebay for their shady ass pathetic tactics. I bought a cheap pre-owned item that arrived different than described. I messaged the seller and told him my thoughts and then Ebay has the audacity to send the seller a proposal for an $8 refund on MY behalf.... Not only are they low enough to try to pull this crap, the whole "not allowed to leave neg feedback until you talk to the seller" is complete **bleep**! I'm going after them.

Mentor1 year ago@cheme_26 You don't have to accept partial refund offers. I have never heard of eBay sending a partial refund offer on your behalf, that would be very upsetting.
I know that sellers can send a partial refund offer once you file a return request.
Sorry your item is not as described. Save yourself some stress and return it for a full refund at the sellers expense.
The eBay Money Back Guarantee over rules the sellers return policy. You have 30 days from the date of delivery to file a not as described return request.
Here's what you need to do:
Open a return with the reason doesn't match description or photos.

Let me know if you need to return an item to another country as there are additional steps required. The seller pays return shipping for an item that is not as described no matter where they are located.

OP1 year agoThe last thing this will be about is the $15 and some change... I couldn't careless, I'm going after Ebay 1000% until they are held accountable.

Mentor1 year ago@cheme_26 I understand that you are upset and frustrated. If you really want to pursue legal action then it has to be through arbitration.
Read this User Agreement carefully as it contains provisions that govern how claims you and we have against each other are resolved (see "Disclaimer of Warranties; Limitation of Liability" and "Legal Disputes" provisions below). It also contains an Agreement to Arbitrate which will, with limited exception, require you to submit claims you have against us or related third parties to binding and final arbitration, unless you opt out of the Agreement to Arbitrate in accordance with section 19.B.9 (see Legal Disputes, Section B ("Agreement to Arbitrate")). If you do not opt out: (1) you will only be permitted to pursue claims against us or related third parties on an individual basis, not as a plaintiff or class member in any class or representative action or proceeding; (2) you will only be permitted to seek relief (including monetary, injunctive, and declaratory relief) on an individual basis; and (3) you are waiving your right to pursue disputes or claims and seek relief in a court of law and to have a jury trial.

Mentor1 year agoAs @comics-scifi-collectibles explained, the offer for a partial refund would have come from your Seller, not directly for Ebay. And if you don't want to accept the partial refund, there is nothing in the rules that would require you to do that, simply decline the offer.
I certainly can tell you are upset, but I'm not sure what got you so upset. Was it just the fact that an offer of a partial refund was sent? I think there is just a misunderstanding here that could be cleared up if you wanted to do so. You have been given excellent advice on how to resolve this issue easily.
What is it that you want Ebay to be accountable for exactly? The offer of a partial refund? I am asking because I'm trying to understand what has got you so upset in a effort to help you. It is nothing more than that. We are all here just trying to help.
