Since s/he didn't have any items listed, and I'm guessing no recent unpaid purchases, you seem to have at least some access to the account and might be able to close it. If you simply were able to access the account because he didn't log out and don't know his password that might prevent you from doing that as eBay usually requires a fresh login for sensitive matters like that. Again though, if no recent unresolved transactions and you don't have the password, there is little danger in letting if just sit there until eBay closes it for inactivity in a year or so.
