Partial Shipment from Buyer
A week after I won a vintage Hockey Table in an auction, the seller finally shipped the item after a reminder from me. Soon after he notified me that somehow, he forgot to include the original box, which was part of the listing, with the shipment. He said it was in bad condition but would send it to me if I wanted it. I told him I wanted the box - I even offered to split the shipping cost.
The next day he simply said he would mail the box. He also posted a picture of the box saying, "it's in bad condition so we're both on the same page." I thanked him for letting me know. Ten day later after receiving no response from the seller, I asked for an update and when I can expect to receive the box. He responded he was out of town and would mail it when returned home on Friday. I thanked him and asked again when I can expect to receive it. No Response. A week later I asked for an update on the box. No Response. Three days later I asked him to please respond to my post. No Response.
Three days later, I told him it had been nearly a month since he agreed to send the box and over two weeks since he last responded. I also told him if I didn't hear from him in the next few days, I would refer the matter to eBay for resolution. No Response. A few days later, July 13, I referred the matter to eBay and as of today, July 18, I still have not heard for the seller.
Not sure what else I can do at this point? Ebay notified me that they opened a case and contacted the seller, but beyond that, nothing else has happened to resolve the matter.
Any ideas?

Mentor1 year agoDid you file a returns request for Item Not as Described? If so, the seller has 3 days to respond. If no response, on day 4, go back to the request and click Ask ebay to step in, to force a refund.

OP1 year agoThanks for your response, disneyshopper. As I mentioned in response to Comics-scifi_collectibles, I am not looking for a refund, I just want the seller to complete the transaction by shipping the original box as he promised to do before he stopped responding to me.
A little background on this transaction: Before the first bid on the Hockey table, I offered the seller $285 under the "Buy Now" option, which was $60 more than the starting bid of $225. He declined. I ended up winning the auction $247, almost $40 less than my Buy Now offer. Whether that has anything to do with the seller decision to not ship the original box, who knows. But it was clear in our conversation that he was hoping I would not want the box so he wouldn't have to pay for shipping again, which is why I offered to split the shipping cost.

eBay can force a seller to send missing items but they can make the seller pay return shipping and refund you 100%. Don't let the seller string you along or your eBay Money Back Guarantee will expire.
The eBay Money Back Guarantee over rules the sellers return policy. You have 30 days from the date of delivery to file a not as described return request.
Here's what you need to do:
Open a return with the reason doesn't match description or photos.

Let me know if you need to return an item to another country as there are additional steps required. The seller pays return shipping for an item that is not as described no matter where they are located.

OP1 year agoThanks for the response and info! I probably should have mentioned in the original post that I do not want to return the Hockey Game, I want the seller to ship the original box as promised. How he forgot to include the original box in the packaging/shipment is beyond me, but then again, the seller didn't ship the item for 7 day and only after a friendly nudge for me, so who knows.
I realize that eBay can't make a seller ship the item, but I would think eBay would issue some sort of penalty of suspension for failure to ship everything promised in the listing. As it is, all I can do at this point is give the seller negative feedback, which I suspect would result in retaliatory feedback against me. I've been buying and selling on eBay for over 20 years and have never received or issued negative feedback. So unfortunately, this would be the first time I gave a seller negative feedback. But this seller deserves it, quite frankly.

I understand not wanting to return... however If you file the return request then the seller may realize that it's better for their bottom line to just do as requested and send the box.
Return requests go on the sellers account.
The only other way to report the seller would be with this form>
https://www.ebay.com/help/action?topicid=4022 Violated one of eBay's policies> other. Then state in the box that the seller did not ship all items that were shown in the photo of the listing. Include the item number.
Sellers can only leave Positive feedback for buyers. If the sellers leaves a negative comment in a positive feedback then you just contact customer service to have the comment removed. This is a policy violation for the seller.
