Non satisfactory resolution fro eBay
I purchased an order, paid through PayPal and cancelled the order for particular reasons. The refund was short $106.99 from what I paid. I contacted eBay Help & Support and they sided with the seller and did not help me get the rest of my refund that I am owed.
I will begin legal action against eBay for not resolving the issue as it should have been.

More details please. First a buyer can not cancel an order, they can request a cancellation from the seller, but the seller has to actually file the cancellation.
When was the purchase? When did you ask for the cancellation? Had the item been shipped to you? Did you return the item to the seller?
Anyway, more details otherwise it is hard to advise you.

OP1 year agoI requested to cancel the order and a full refund from the seller on April 27th, the purchase date was April 20th.
The part for my vehicle was listed/advertised; however, not available for shipping because it had to be removed from the vehicle. I was already unhappy at that point because I wanted the part before I had to go out of town. The seller finally agreed to cancel the order per my request; however, I received a refund to my PayPal account that was less than the purchase price/cost. I paid $406.58 but received a refund of only $299.59. The order was cancelled before a shipping process was initiated, it is not a returned item.
I submitted this issue to eBay Commerce and the response to my report was that there was not a violation from the seller. Then the violation rests with eBay Commerce and I want resolution otherwise I am beginning a litigation immediately. I should not be inconvenienced this way and I have lost confidence in placing orders through eBay now.

Any violation you are assuming Ebay made or any litigation you may decide to do is between you and Ebay. I have nothing to do with that.
There is a reason that amount was deducted from you. I'm trying to understand that reason so I can better help. What does that amount represent. I understand you disagree with the deduction of this amount. But to be able to explain it I first have to understand it.
Did the seller or Ebay tell you why the $106.99 was withheld? If so, what did they tell you?
From looking at the listing you purchased from it was $279.99 for the item, $99.99 for shipping = 379.98. The difference between 406.58 and 379.98 = 26.60. Was that how much your sales tax was?
Your cancellation request was 7 days after your purchase. Are you sure the seller didn't ship the item? If they did and contacted the carrier to return it to them, there would have been a cost for that. Were you ever given a tracking number?
I know I have a lot of questions. I'm not trying to frustrate you, I'm trying to understand what happened here so I can try to be of some help to you.

OP1 year agoYes, I believe the $2.60 was the tax.
No the item was never shipped. (I thought I mention that) I did not receive a tracking number because it as not shipped.
I was not given a reason for the deduction of that amount.
I don’t understand what happened any more than you. I placed an order for the part listed. The part listed was jut a photo of a similar part but not the one to purchase. That part had to be removed from a vehicle and it took a few days waiting on them; in which, I told them to refund my money cause I was not comfortable purchasing it without seeing the condition of the part. He sent pictures after he removed the part from the vehicle (still hadn’t refunded the money like I asked and it was less than 7 days when I initially asked for a refund). It was at that point when he asked if I still want to cancel and I replied Yes.
I received the refund, $106.99 short of what I paid.
