No reply from seller re product problem. Now beyond refund request deadline.

On May 25, I purchased a pair of Brooks Glycerin Max (version 1) running shoes from Dean Fashion.
On June 24 I sent them a message asking about the very stiff bottom of the shoe that is supposed to be soft cushion.
As I had no reply as of yesterday, August 23, I sent another message noting the cushion for the shoe they shipped me was nothing like any Brooks Glycerin Max (version 1) on YouTube.
I asked for a replacement with the correct cushioning which is a soft, blue interior cushion, not a rigged styrofoam stiff white stiff, inflexible as seen when removing the arch support insert of the shoe.
I can't access return or refund for the product. What can I do. Thanks for any feedback.
Note: Why the long delay between June 24 and August 23. I've been helping my sister start her journey with a terminal health condition which was a priority. I can prove this if needed.

eBay can’t help once it is more than 30 days after you received the item. You can call your credit card issuer and ask them to open a dispute for an item not as described - most will help for up to 6 months.
I’m very sorry about your sister.
