New without box means new ?

Hello community, a query, I bought (with an auction) a perfume that said "new without box" when it arrived I realized that it did not come full and only 60%, when I checked the original notice, indeed in the photos it was seen that it was 60% and in the description said 60%, but in the original notice was used the "new without box".

is it misleading advertising ? is there any compensation due?

Return it at the seller's expense. Used perfume is not allowed to be sold here.
