Need help with item received not as described. Seller was rude, accused me of lying and blocked me.
I ordered a pair of shoes advertised as size 7.
I was looking to replace the exact same model of a discontinued HOKA recovery shoe.
When I received them, they were at least 2 sizes smaller than advertised. I sent photos of the original authentic pair I already own next to the pair sold to me through eBay comparing the size.
Photo:The issue here is that the size is marked as 7 but they measure as 5 or smaller.
I also took photos of size 6.5 HOKA shoes next to the shoes sold to me as "size 7" to show the difference in size. In the photo I am holding the size 6.5 label in the shoe on the left, next to the ones sold to me as size 7 on the right.
The shoes sold to me and now in dispute are marked with 7, which leads me to suspect that they are counterfeit, perhaps unknown to the seller. Because it might not have been her fault I tried to make it work by giving them to my mom, who has size 5.5 feet. They were too small even for her. It took a couple of weeks to get them back from my mom.
Within the 30 day period I tried to return them, but seller was rude, accused me of lying, and said "I'm sure you won't get your refund!" In her feedback profile when other buyers complained, she replied in a similar rude and defensive manner accusing the buyer.
Can I please get a second opinion on my photos, do they sufficiently show that I received an item that was not as described? Does the fact that the shoes are marked 7 even though they don't measure as 7 mean that I am not entitled to a refund?
I sent the seller additional photos to try to work this out. She accused me of lying, blocked me, and was extremely rude.
Thank you.

·2 years agoHi @brdrgrrl , thank you so much for letting us know what happened! Sorry you had to deal with someone like that. Abusiveness is not acceptable.
Report the abusive messages: On a computer, at the bottom of the message, click Actions > Report.
(If you're on the phone, use the Report link below to separately report the seller for violating policies in messages.)
Report the seller for violating eBay's policies in feedback. Sellers are not allowed to leave buyers a negative comment with a positive transaction rating, so eBay should remove the feedback she left for you.

OP2 years agoI wanted to provide an update to the outcome, thanks for the advice from @tree*fern and @house*of*paws
When I submitted the refund request, the seller refused and called me a liar, among other things. She sent me mean and abusive messages saying I was a lying scammer wanting free stuff. Why would I want free counterfeit shoes that don't fit? Until this week I had never left negative feedback for anyone. Even if a seller handles a sale poorly, I do not leave any feedback at all rather than something negative.
She went out of her way to insult me, so I left negative feedback. It was factual and non emotional. I even wrote that she is a great seller as long as there are no issues, otherwise beware. She wrote in the reply to my feedback that buyer is a scammer and total loser. She replied in the same manner to another buyer's complaint with a neutral feedback rating.
She later revised the reply to: Buyer has been blocked and I pray for her other victims of her scams. Please beware and don't sell to her or problems await weeks or months later.
Isn't that statement still defamatory?
After the waiting period, eBay stepped in and resolved the case in my favor, just as the advisors in this post predicted. I was instructed to return the shoes with the shipping label provided.
The Seller left me feedback on my profile, writing: This buyer is a scammer! She is a complete loser! Seller's beware!
The day after I received the shipping label, eBay emailed me:
to return an item, it needs to be in the same condition that you received it and you won't be receiving a refund.
I don't know why they did this, because I hadn't even printed out the shipping label yet.
I contacted customer service and explained the situation. I promptly received a refund. The customer service agent said they had already released the funds back to the seller when they granted her appeal, and that the refund came directly from eBay.
I don't know what really happened behind the scenes and what she did to make eBay decide in her favor at one point, but I hope eBay didn't have to pay for Seller's mistakes.

Mentor2 years agoHi @brdrgrrl
Had you chosen 'Item didn't match description or photos' as the reason for opening a return request ... you would have been guaranteed an eventual refund.
IF you chose 'item doesn't fit' as the reason ... AND the seller has a 'no return' policy ... THEN the seller is allowed to refuse the return.
I cannot see any photos you left ... so cannot offer any opinion on them.
[I had a similar problem several years ago with a pair of Nike, Size 12 shoes, I purchased. They were 1-1/2 inches shorter than other Nike, Size 12 shoes my dh had on hand. I received a refund upon return of the shoes. because I was aware of the problem of using 'doesn't fit' as a reason when shoes are mislabeled ('seconds') OR counterfeit.]

OP2 years agoThank you! Yes, I used the didn't match reason.
I am trying to repost this with photos. I hope it worked.
Thanks again.

·2 years agoHi @brdrgrrl Submit a return for refund request if it's been less than 30 days after you received the item.
How to return an item for refund, for Item Not As Described:
https://www.ebay.com/help/buying/returns-items-not-received-refunds-buyers/return-item-refund?id=4041
I hope it's not too late. EBay's Money Back Guarantee always overrides the seller's return policies, and whatever they may tell you in messages if they're trying to refuse or prevent a return.

·2 years ago@brdrgrrl You're welcome! I'm glad you were able to submit the request in time for Item Not As Described.
You don't need to post the photos here, we're other eBayers like you so we don't make the decisions on returns. But like @house*of*paws said, you're guaranteed an eventual refund.
