Molded package, INAD. Seller only wants to refund $10/$231...
As someone who doesn't use eBay often, how can I get my full refund if me and the seller are not on the same page?
I got a pair of jeans in the mail with a hole in the package and a light smell but did not think much of it. Upon opening, I was blasted with a horrible smell. Further inspection led me to find mold throughout the waistband of the jeans slowly spreading downward. I immediately washed my hands to switch to gloves since I did not feel safe with bare hands. Currently, they are in a bag in my backyard left as is.
After talking to the seller for a complete refund, they said they could do only $10-$15 out of the full $231 purchase. This was for the mold and because they assumed I used bleach. They didn't even ask any questions! I did not use any products, just my hands and a pair of gloves.
They said they can't take them back nor refund because they are described as being "sold as is". Is that true?
I also found that the product was horribly described! There was a statement saying the jeans had "been tested for rot and washed in washer no rips". However, in person there were signs of dry rot all throughout the fabric since they contained unmentioned rips. I messaged the seller and it turns out they knew there were holes and dry rot all along yet did not want to say so in the description.
The item was horribly described, came with mold, and seller does not want to refund or a return. If anything, I just would like my money back but I don't know how to.
I know that an INAD is eligible for EMB, but I do not want the seller to send back $10 when they receive the item, making me at a loss of $221.

I would stop communicating with the Seller and immediately open an INAD. She will then have three business days to respond with either a prepaid return label or a full refund. Once you open the INAD, I would only communicate with her through the case. If she hasn't resolved things on time, on the 4th day go back to the INAD and ask eBay to step in and force the refund.
If she approves the INAD, be sure to return the item. Once received, she will have two days to issue a full refund.
If she deducts part of the refund, go back to the case again and ask eBay to step in.
Don't let her string you along or try to get you to close the case.
I'm sorry this happened to you.

OP1 year agoSo I just got some notifications from their response. They replied to a message I had left and requested back a partial refund of 1 cent 🤦â€â™‚ï¸ with me keeping the item. They said they were on the phone with eBay saying "exact" situation and how I "thrashed them with bleach to get rid of the rot". What do I do? I am having problems contacting eBay for a call with a real person. Thank you though.

My exact advice still stands. This Seller is trying to bully and manipulate you.
Please stop communicating with her and open the refund request. Do not agree to close the case based on false promises from her.
If you need to contact eBay, message them on their Facebook page.
