Did you ever register as a retailer with MO DOR? It sounds like you should have registered, and then you would have collected sales tax on your MO sales, and filed sales tax returns.
You mentioned responding to 2 letters - what did they want you to submit beside the tax money? Did they ask you to fill out tax returns?
i received a letter saying i might owe 4000. and to respond so i did and i had the company that does my income tax respond, got 2nd letter they never received our Reponses. tried again. Third letter i received was bill and i had to appeal to a commission now i have a court date but i can send paperwork to commission to try to resolve matter.
they are using my 1099 and charging me sales tax on full amount
The company who does my told me i didn't owe it but now i guess she was wrong
going to print reports and look for mo dor paperwork form i need and submit it to commission
according to mo dor website im a marketplace seller and i dont need to register
there is a lot of confusing info out there, im in a small town so help is hard to find
i really appreciate you taking the time to talk to me
The state always makes the assumption that gets them the most money and then lets you prove them wrong.
Every state sets their own threshold for requiring tax collection, so it was always safest to register then collect and remit very little. Since you didn’t register, they are starting with all of your sales.
I think if you fill out the tax return form showing that most of your sales were out of state, and that you accept responsibility for tax on your MO sales - which you will calculate on the form - they should not want to spend time going to court.
As I mentioned, they will probably add penalties and interest, but if the tax amount is small the interest will also be small. The sales tax return form may have the calculation on it.
I’m going to download the MO form in case you have other questions.
