MISSING PACKAGE CLAIM
This is my first experience with what i will assume is a stolen package and I'm caught in a loop of pass the buck between EBAY and UPS with seemingly no way forward and a very upset buyer
I have a package that UPS Claimed to have delivered ... but their proof of delivery photo appears as if the UPS driver left the package at the curb near the street next to the driveway entrance rather than running it up to the front door of the house
I have a buyer with security footage that shows that no UPS driver approached the front door during the alleged time of delivery
I have UPS saying i cannot file a claim for the missing package because i purchased my label through the eBay platform and therefore it is eBay's account and eBay would need to file the claim as the account holder
I have eBay saying that UPS delivered the package to the address and therefore no claim is required .. if the package was stolen from wherever UPS left it then its just tough luck for the buyer and they are out the $400
My position here is that if the driver left the package at the curb then that's negligence on the driver . The buyer paid to have it delivered to the their door as is the norm.
Has anyone found themselves in this pickle before and have any advice on how to get one of these entities to take action or open a claim?

Mentor2 years ago@thejingman If UPS has tracking that shows delivery to the address then they are not going to pay an insurance claim. This stinks for the buyer but it is not the sellers responsibility.

All evidence leads to the UPS driver doing the funny farm bit where he just tossed it out the door as he drove by and left the package at the curb ... that is not UPS policy ... they walk i to the door .. and that's what you pay for ...
As a seller not being able to so much as file a claim or actually speak to a live person is also extremely lacking ....

OP2 years agoI'm 100% certain your are correct ... but you have to concede the point im trying to make here. This is a really weak policy. " That stinks for the buyer " while accurate ... is not a solution to what is most likely a common problem ...
Ebay exists because of the sellers and the buyers ... This particular buyer has essentially had the door closed on his face. He didn't get his package ... he has compelling evidence that UPS did not deliver it where they said. He should at minimum be able to file a claim. Not simply told No Sorry ... UPS claims they have "proof of delivery" which consists of a blurry photo and a gps tag from the driver tablet ... OK .. well here is the GPS location for the Door in question where the package should have been tagged if properly delivered ...lets compare that to where your driver tagged it ... and UPS says no we don't have to supply that. Which is shady ... UPS is willing to open a claim but ... the label was purchased by EBAY so Ebay has to file the claim ... and Ebay simply says no...
Amazon has stolen packages on a daily basis ... they take care of their customers when something goes wrong with basically no questions asked . Ebay is perfectly capable of doing the same. Have you seen these Ring camera reels ... Amazon driver drops off the package in his blue vest and tags it ... the drives around the block takes off the vest and pulls his hoody over and steals the package he literally just delivered ... I mean it happens all the time ...
Listen im poor .. which is why i have to supplement my income with ebay ... this customer had a great rating and i cant help but think that $500 bucks is a lot of money to them too ... and he will probably never use ebay again because they just burned him by refusing to take any action... IF UPS can show that the driver tag matched the door then ok ...investigation closed ... but if it doesn't and its 300 feet away as it appears in the driver photo .... then the Ebay customer deserves to be able to file a claim and Ebay should allow that.
I think that is more than reasonable... If the Ebay community cant promote policy changes to improve the platform then they are curbing their own success
