Misrepresenting location

Question

Yesterday I purchased a gift for my grandson. The item stated located in the US. Today I got an email with the tracking info. Turns out the item is not located in US, but is being shipped from Israel. Now it will not arrive in time. I have looked for a phone number for eBay to report this fraudulent advertising, but can't find one. Is this type of false advertising acceptable? If not, how can I report it to them. As I paid using my bank debit card, I am SOL with regards to cancelling the order....

Thanks to all of you for your quick responses and very useful information. If the item arrives as pictured I am going to keep it as it is meant as a birthday gift for my grandson. It isn't real expensive, so the money isn't the issue. What gripes me is that I specifically searched for the product with a US location so that I would get it in time for his celebration. Per the tracking I received that isn't going to happen. So I will go shopping locally for another present I can give to him during the celebration. The other one will end up an additional surprise. However, once received, I will file a "not as described" complaint as they still shouldn't be advertising as located in US. Thanks again.

@greenefan I understand and share your frustration, my reply is long because I want to make sure that you are aware of all of your rights as a buyer.

You really want to file the NOT RECEIVED refund request as soon as it is one day past the last estimated delivery date or you are going to have a problem with tariffs. I can explain what do to do if the item does arrive and tariffs are due. Just reply to this post.

Advise the seller that per eBay policy they are required to to state the true location that they are shipping from on the listing and that if they do not cancel and refund you NOW that you will be filing an eBay Money Back Guarantee case.

You should report the seller for violating eBay policy by lying about the items location. eBay doesn't know that the seller is shipping from a different location than stated on the listing unless they are reported.

The seller will not be able to provide a valid return label since they are located in another country. If the seller shipped from the US they are not allowed to require a return to another country even for buyers remorse returns. Sellers are required to pay return shipping for not as described items no matter where they are located.

The seller then has the choice of sending you the money to pay return shipping to your PayPal account OR refunding you without a return of the item. Do NOT pay return shipping yourself and expect to be refunded for it after the item is returned even if an agent says to do this as eBay can not force a refund from the seller for more than the original sale price.

eBay may place the case on hold for 5 days if the seller chooses the PayPal option.

99% of the time a seller in another country will refund without a return of the item once you involve customer service.

If you do have to buy a return label with the funds the seller provided then you MUST enter the tracking number into the return request so you will have proof of the return.

If you really want to cancel, message the seller and tell him you are going to report the location misrepresentation, plus you will open a not as described return when it arrives late. The seller pays the return shipping and issues a full refund when the item is not as described, and late arrival makes it not as described. Tell him you would prefer a refund now so you can get the item from another seller in time to meet your needs.

To report the location misrepresentation, click the ? in the lower right corner, select report item, then a problem in the listing, then location is not correct. In the box write that the item is shipping from Israel.

If the item arrives late and you want to return it, we can give you instructions on how to open the correct return, and how to get eBay to instruct the seller to send you the money for the return shipping.
