Misrepresentation- False Advertising

Question

I purchased an item which was listed as â€œNewâ€. I received the item which was in open box condition, broken seals, missing manufacturer packaging, etc. I have screenshots of the exact listing I purchased as well as the open box item/condition. Iâ€™m an experienced eBay user and have contacted the seller, but have not had this issue before. I would like to know what I should expect and what other action I should take? Contacting eBay about this has been troublesome as well.

Since you are an experienced Ebay user you already know about Ebay's Money Back Guarantee. You can file a Return Request.

Within 30 days from date of delivery, go to your Purchase History, find the item, and under â€œMore actionsâ€ click on â€œReturn itemâ€ and select the reason for the return. â€œDoesn't match descriptionâ€œ. Attach a photo.
IF your request is approved, the seller will have 3 business days to either accept the return and provide a prepaid return shipping label OR refund without having you return the item.
If they don't do either, you can go back to your Return Request details 4 business days after you filed the Request and ask Ebay to step in.
