Item sold as new but was refurbished
Hello,
I purchased an iPhone in January of this year. Phone was advertised as "brand new". After activating and beginning to use the phone regularly I began to notice the battery was not lasting very long. I finally managed to take it to an Apple store in May to have the battery replaced. As I was picking up the phone after the repair the tech mentioned (after opening the phone) this phone was actually refurbished and proceeded to tell me the history of the phone along with other information about certain features which didn't work. The minute I got home I wrote to the seller and asked for a refund. Initially he confirmed and mentioned the shipping label would be sent out however I have never received anything and have been writing to the seller ever since without any response. I want to file an official complaint and get my money back, what is the best course of action? Thank you

It is too late for eBay to help - you have to file a claim within 30 days of receipt.
It is probably too late for your credit card to help, but it is worth a call to them. See if they can open a dispute for an item not as described.
