    item permitted or not
                     

    I recently acquired some frosted lucite figures. They are artistic figures of nude women. Such as item number 

    235702997017. I am not objecting to this item, nor to several other items made by the same company , that are currently listed on Ebay and others that have been sold. As I have learned just because someone sells something on Ebay does not mean that it is permitted. These are art forms to me but I need clarification of Ebay policy before I attempt to list them.  Could you please provide clarity to me on Ebay policy so I do not so I don't create an illegal, according to Ebay, listing. Thanks for your time.

    If you are going to list a similar item, you would be safest to list it in a subcategory of "Art" (rather then collectibles) and include the Item Specific: Subject: Nudes

    If you list it in collectibles, I still recommend you use Subject: Nudes

     

     

    Here's the policy

    1) Nude art listings that do not contain sexually suggestive poses or sexual acts are allowed, but they must include the "Item Specific" attribute Subject: Nudes.
    - The "Item Specific" restricts to 18+

    2) They should only be listed in the following categories:
    - Art categories
    - Collectibles > Paper > Pin Up > Vintage (Pre-1970)
    - Collectibles > Postcards > Non-Topographical Postcards
    - Collectibles > Photographic Images > Photographs

    Thank you for your help.  But, as you say I would be "safest" to list it as you stated. I don't understand why they cannot have rules that are concrete and applied to everyone equally. Several years ago I listed an old police/safety bubble style light from a police car or safety vehicle. It had a blue lens and was not functioning and could only be used for parts. Ebay  removed it because someone could buy it and pretend they were a policeman and pull people over.  However, there were many others sold and active with a red or blue lens that worked at the same time I had mine listed. Yet, mine was removed. Someone recently sold a restored police car and it was done to imitate a Adam 12 police show vehicle. Everything worked on it, lights etc and police logo on the doors. They were able to sell it with no problem. I have trouble understanding rules that don't really apply unless someone reports you.  Thanks again for your help.

    With billions of active listings on eBay at any given time, eBay cannot perfectly enforce all the various policies, so many things rely on user reports to be caught, especially since many of the sellers who violate those policies are intentionally deceptive in order to avoid being caught (not saying you were, just giving you an idea of why it is so difficult to effectively enforce many policies).

    It's a bit like speeding, you're not allowed to do it but some people do, some get caught and some don't. You're still not allowed to do it though. Those sellers are risking their accounts by listing these items and that can catch up with them at any time.

     

    Your particular glass nudes, assuming they are similar to the example listing is to me artistic and not pornographic.

     

    I don't know if you must follow the art nudity rules or not for glass.

    I don't see others in this category following those rules, though.

     

    Police lights aren't allowed.

    I don't actually know about equipped police cars, it would seem they would be prohibited,  but I do not know that one.

     

    I share the same frustration with the rules not always being enforced. You can report listings using the ? on the lower right or the 3 dots ⋯ in the upper right.
