    Hi,

    So I purchased an item on here and received a message from the seller that he can't afford to pay the shipping fee. When I tried to cancel the order, I got this message from Ebay saying that it is too late for me to cancel this order. We have messaged each other regarding this dilemma and he says he can't cancel the order. Now, there are two questions: Does the seller receive my payment after I receive the item or as soon as I purchase it? Also, if it is possible(I have not seen anything on this site that explains how to resolve this issue.) how can I get Ebay to step in and resolve this?

    The seller said that he does not have enough money to pay for shipping and he can't use my money because it is being held.  He claims that the only way he can pay to have it shipped is if we wait for Ebay to release the funds to him.  What can I do to avoid a ransom situation? Please give me a detailed description of how I should handle this.

    You should not OK the cancellation of the order. The seller is obligated to ship. If he doesn't, he needs to cancel the order and earn the defect for not doing so on his account. There is no reason why he can't ship with the pending funds on hold from your payment.

     

    Reply back to the seller with this:

     

    I do not approve a cancellation on this order. I want the item that I ordered. You should be able to create your label through eBay using your pending funds. If you are not going to do that, then you need to cancel the order yourself using the cancellation option in the dropdown next to the transaction in your Orders list and select the reason that you are out of stock. If you mis-represent the reason for the cancellation, that will be reported to eBay.

    The seller's payment will NOT be released until he ships and the item is delivered. So if he doesn't ship, your next step is this:

     

    When it's past the estimated delivery date shown in your Purchase History, you have up to 30 days to use the option next to the transaction to open a case for an item not received. The seller will have 3 business days to prove delivery or refund. If he doesn't, go back to the case on day 4 and use the option to ask eBay to step in.
