Item never shipped and no reslonse

Question

I placed an order Jan 16th. I received a message saying it was “behind” so I stayed patient because I still wanted item. I’ve messaged seller 4 times and opened a case. Now eBay is saying because it’s over a month it’s not covered by EBay and seller won’t respond.
it won’t let me cancel order either. What do I do?

To take advantage of eBay's Money Back Guarantee, you need to open an item not received case within 30 days of the estimated delivery date shown in your Purchase History. Be sure to pay attention to deadlines and don't fall for seller excuses like they are running behind. They are REQUIRED to ship within their stated handling time. (No legitimate seller is running two months behind on shipping. A good seller would refund if he couldn't ship.)

At this point, you can check with your credit card company about a chargeback.
