Item #387187075887 Pampered Chef Mix Chop Meat
Title clearly states that this is Pampered Chef! When you continue to read the items specifics it is stated that this is unbranded. How can an Unbranded item be listed and referred to as being Pampered Chef? Is that not misleading to even have Pampered Chef anywhere in this Heading or description? I submitted a report about this item and ebay returned a decision that this was not in violation of ebay policy. Found no violation according to ebay customer service agent.

OP2 years agoLook closely at the picture. They are using Pampered Chef's name to draw attention to the listing. There is no error in the listing! I am not buying it. I am trying to make a point. This is what it should look like. The picture of the Pampered Chef website is a poor picture, but on the right side of the shaft you can barely see some of the insignia. I don't know why they don't have a better picture on their website to clearly show the Pampered Chef logo. Tell me what is the mystery?

OP2 years agoI guess I didn't make it perfectly clear about my issue of allowing sellers to use the Brand Name of a Leading Manufacturer in the title of their listing. Pampered Chef or any other use of any manufacturers name in the listing should not be allowed. In the item specifics the seller has CLEARLY marked this as UNBRANDED so that would be misleading and deceitful in my opinion. Pampered Chef should not be the highlight of this listing as it is and with 1,000's of other listings. If you have been around long enough you will as a buyer may happen to see an item and miss the item specifics or they are missing from the listing and may have inadvertently placed a bid or purchased and later discovered that it was not in fact what you thought you were purchasing because the listings heading states (Pampered Chef). My point is that I want this practice to stop to protect all buyers (experienced or inexperienced) from these sellers that are using a Leading Manufacturers name in their listings when in fact it is just a knockoff of the item. Ebay states that you should be honest when listing! Take a look for yourself and look up any item and notice how many misleading titles there are.

OP2 years agoInceptions, Are you condoning this practice of misleading buyers? It seems that you don't understand the issue or you are just like the ebay customer service agents! I know about ebay Money Back Guarantee, but the point is that my funds are being tied up while I wait for my refund from a seller that KNEW that it was not a Pampered Chef item at all. For Example: Actual listing # 387187075887. As I thought I clearly stated that the listing heading is Pampered Chef Mix Chop Meat______! In the item specifics it specifies UNBRANDED. This type of listing practices are extremely widespread all across ebay in every category.

OP2 years agoI have been a buyer and seller for 23 years and have seen a lot of changes in ebay. I think it is wrong for any lister to use the Manufacturers name when the item is not what you are listing it as. Unbranded does not and should not allow you to use Pampered Chef's name in any form or likeness.

I don't know how you found anything in @inceptions reply that condoned the seller's misleading actions. You merely were being told that you would be able to get refunded regardless of whether the item turned out to be branded OR unbranded. [How you found a reason to insult a volunteer who was trying to help you is beyond my imagination.]
eBay has no way of knowing whether or not a seller's listing is accurate. The listing in question does violate eBay policy and might be removed if reported ... assuming the CS rep reading the report understood WHY it was reported. There appears to be many reports that aren't being understood ... especially when the report doesn't contain a 'message box' to explain the reason for the report.

OP2 years agoHow long does it take to get your refund? Why should I have to rely on the sellers feedback for the item? The seller listed this and the specifics state that it is unbranded, so I conclude that they should not have Pampered Chef in the Title of the listing. It is simply not a Pampered Chef item! If I have a Sunbeam battery that I want to sell I am not going to use Duracell in my Title of my listing. It's a Sunbeam Battery (AA).

·2 years agoThe proper way to have eBay take a look at the listing is to use the Report Item link (found in every listing). Report it for Listing Practices, Keyword Spamming.
I was recently discussing with another Mentor about an item that I had seen for sale (on another site), and mentioned to the Mentor that if it was on eBay, I would report it as Keyword Spamming. The item in question was a spinning wheel that had been listed as “Ashford styleâ€, when it was clearly an older, probably non functional spinning wheel. Ashford is a brand, not a style. It would be like calling an old car a “Cadillac style†car. This used to be extremely rampant on eBay years ago. I remember shopping for children’s clothing 20+ years ago on eBay and having to wade through listings that said “Gymboree†or “Osh-Koshâ€, but when you opened the listing it was generic clothing from Walmart.
You don’t see this very often anymore (thankfully). And, as @inceptions pointed out above, these days eBay has made it reasonably easy to get a refund if a seller does list in this way.

What did I write that made you think I was condoning the practice of misleading buyers? The item may be a Pampered Chef item and the seller merely made an error in the item specifics. There is no way to know that for sure unless you see the item.
(Thankfully, when I have made a mistake in a listing, I've either caught it myself or a buyer has messaged me to ask for clarification rather than immediately branding me as a scammer. I once listed a $10.00 item for $1,000.00. It was an obvious mistake...apparently I had the jitters when I was typing the zeroes or something. A potential buyer alerted me, and I quickly made the change. Perhaps you have never made a mistake, but I know I have, and I appreciate it when someone gives me the benefit of the doubt before accusing me of something illegal or unethical.)
I looked at the listing before replying to you. My first inclination was to think the seller made an error in the item specifics, but when I looked at the seller's feedback, I was not impressed. That's why I suggested you think about it before buying from that seller.
I'm sure you have your reasons, but I don't understand why you concluded that the item specifics are correct and all the mentions of the brand name in the title and description are not... It may turn out that the seller IS trying to pull a fast one, but there is no way to know based on what you're looking at.

OP2 years agoI gave you the item number so that you could look at the pictures that the seller supplied. Where on this item does it show the Pampered Chef on it. Genuine Pampered Chef items have the Chefs hat and the words Pampered Chef right in the handle.
I think you totally missed my point. Yes I am not as righteous as you to seem to think I am. Yes I have made a mistake as a buyer and seller. These sellers I am mostly speaking of are seasoned veterans and many from outside the US (China extensively). Abusing the system.

This might not be the answer you are looking for but at some point, buyer's need to be responsible for the items they are purchasing. That seller has very poor feedback and the item does say "unbranded"
It is unfortunate that eBay did not recognize the item as counterfeit or not the correct brand.
My suggestion is to contact Pampered Chef. They can have that item removed if they are members of the Vero program. That would be an effective way to shut down those fake listings.

I see no logo on the item.
Maybe saying this a third time will work...there is an error in the listing. Everyone agrees. What only YOU are saying is that the item specific is correct and ALL the other references in the listing are wrong. How you know that is a mystery to me. If you don't believe the item is authentic, then don't buy it.
I don't have anything more I can add here.

The item cannot be both branded and unbranded at the same time. Either the title and description are wrong or the item specifics are wrong. Perhaps the seller made an error when filling out the item specifics. Either way, you are covered by eBay's Money Back Guarantee if the item doesn't match the description.
If you look at the seller's feedback, you'll see he doesn't have a good track record. It's up to you whether to take a chance or find another seller.
