Is my appeal decision fair
Summary: nini1971 purchased a pair of pants on eBay but received a worn-out t-shirt instead. Despite contacting the seller and eBay for resolution, the seller falsely claimed to have sent the correct item using the original tracking number. eBay closed the case, siding with the seller, leaving nini1971 without a refund or the correct item.
I bought a pair of pants on ebay. Seller sent the wrong item (worn out tshirt), which was delivered with a tracking number. When I contacted seller about the error, I got no response. I then contacted ebay to intervene, and they inquired. Seller told ebay they would send item but never did. When I asked ebay to follow up, the seller gave ebay the original tracking number for the wrong item that was delivered. Ebay says the item was delivered and closed my case with no refund. Basically, the seller was dishonest, I never received my purchase....I did receive an old worn out t-shirt from the delivery tracking number.

If received less than 30 days ago, open a not as described return. Your not received claim was closed because you did receive a package. The issue is that it is not the item described in the listing you purchased.
Go to your purchase history - select return this item. Under reasons select does not match the description, and follow the prompts. Describe what you received in the comments.
The seller has 3 business days to send you a return label or a refund. If he doesn't, or says he cannot send a label, go to your case and click 'ask us to step in'.
If it has been more than 30 days, call your credit card issuer and ask them to open a dispute for an item not as described.
