eBay has removed my listing for an original release Nintendo Switch. I appealed the decisions and spoke with a CSR via chat. He is claiming that ebay does not allow the sell of Nintendo items without approval from Nintendo and then is sending me the policy for infringement and copyright.
First off the CSR is siting the wrong policy, I believe the policy he is actually referring to is Verified Rights Owner Program in which Nintendo is not listed as a restricted item. Secondly, as of right now, there are 26,000+ completed sales of Nintendo branded items.
The only thing I can think of that my listing has that is not OEM is a custom shell that I installed and I am including a tri-wing screw driver if they want to swap the shell back to OEM. I could foresee that eBay is considering this as an illegal modification that Nintendo would discourage or find legal recourse against.
Is eBay seriously this obtuse?
