If UPS denied my claim, and I did file an appeal who pays if they deny again?
Summary: wisconsin-recycling-vintagelove describes a situation where a large package of glass cookware was damaged during shipping, despite careful packaging. UPS denied their claim, prompting an appeal and a separate claim with another insurer. jacbarcollectibles advises that wisconsin-recycling-vintagelove is responsible for refunding the buyer if the claim is denied again, and suggests that the outcome often depends on the condition of the packaging and the reason given for the denial.
I sent a large package of glass cookware, I went out of my way to buy an extra heavy box, several rolls of bubble wrap, and several packing pillows and an entire roll of packing tape to make sure everything was secure. The box showed up smashed, UPS denied the claim, I filed an appeal, I also had the ship cover insurance and I filed a claim with them and I’m still waiting. If all of this fails who has to pay? Am I expected to pay the buyer after I took all the steps to ensure a safe delivery and the system decided to fail tha? Pretty much all of my feedback mentions how well I packaged things. If the other insurance company should deny me as well, am I liable for paying back this buyer?.

Mentor3 weeks agoSorry this happened. Unfortunately you are responsible for the package until delivery is made. So you are responsible for refunding the buyer in full.
What reason did UPS give for denying the claim? As long as the packaging shows heavy damage the shipping carrier will usually accept responsibility. If the packaging only shows minor damage but the contents are damaged they will claim improper packaging and deny the claim. No idea how ship cover may rule.

OP3 weeks agoIt was packed with a heavy duty brand new box, everything was wrapped in bubble wrap, and then I put several air pillows in and pieces of foam in the corners to reinforce. I used almost an entire roll of tape because it was a 12 piece vision cookware set made of glass. I have never had something break on me and in fact most of my feedback mentions how well I packaged things. The box is smashed, not a lot, but obviously it’s only going to smash down so far. They sent the driver to look at it, which makes no sense to me. So you sent the person who very well damaged it to tell us if it was damaged? That makes no sense and the photo that UPS gave as proof of delivery shows the box smashed. I filed an appeal, but I just don’t have very much faith because they told me it’d be 1 to 2 days and it’s already been five and I’ve heard nothing. I did try to file the rest of it with that other insurance through eBay and I haven’t heard back from them yet. But I packed it exactly as UPS requires. The more I’m on eBay the more it feels like sellers are not protected, it’s mostly just buyers. I purposely bought two different insurance for it and somehow in the end I have a feeling I’m going to be stuck with the Bill and I packed it perfectly.
