I am trying to list the very same item that many others have listed right now and have recently sold
and it says I cannot sell a medical device.

The way to determine whether you are allowed to list a particular item is to review eBay policies rather than look to see what other sellers are doing. If another seller is violating policy, eBay may catch it or it may be reported by a member who sees it.
