What 90 days are you referring to? eBayâ€™s money back guarantee is for 30 days.

eBay has a full Money Back Guarantee when a buyer receives a locked phone. The buyer has up to 30 days after receipt to open a "not as described" return case with eBay, and eBay will give the seller up to 3 days to respond with a return label. If the return label or refund is not provided within those three days, the buyer can ask eBay to step in and eBay will settle the case in favor of the buyer.

How were those steps missed? Were you not aware of how eBay works? Did the seller string you along to run out the clock?

After 90 days, the listing itself is no longer on eBay and can not be dredged up as proof of anything. I'm sorry this has slipped past the period where eBay can help. Since eBay has options in place to avoid problems like this, you won't be able to sue eBay. However, you might be able to take the seller to small claims court.
