How to ask e-bay to step in because i can't deduct anything and a buyer clearly used/damaged the ite

Buyer used the item. Its got dent and the camera lens is scratched/dinged and I can't sell the item again in the previous condition i had it in. The buyer should be responsible for some of my loss and used/abused the return process. How do i get ebay to step in... do I have to wait 3 days?

Sellers can only withhold up to 50% of the refund if the item is returned in a lessor condition than was sent if the seller is top rated or has a 30 day return policy. The listing I found has no returns on it, so you need to issue a full refund since the buyer filed an Item Not as Described.
