How i can force seller cancel order. Item is out of stock

Question

HelloI bought an item is supose they have in stock or available to sale and ship. But when they notify the warehouse to proceed to delivery, warehouse house said is out of stock. So they can not send me the item and they told me i have to start the canceling process but they create the shipping label amd for the ebay system the item is on coming but justhave the label create no item no carrier. How i can force to cancel the order and get my money back. Thank you

If the seller neither cancels nor ships, the buyer can file an "item not received" case starting the day after the last estimated delivery date shown at the time of purchase, and then ask eBay to step in three business days later to force a refund.
