How do I start a class action lawsuit against a seller and eBay?

Seller was sent back defective item and kept the item and the money I paid with the help from eBay!!

If you used eBay's return process within thirty days of receiving an item that was "not as described", once the tracking shows that the returned item has been received by the seller, the seller has three business days to refund you or else you can ask eBay to step in and force a refund, for up to twenty-one business days before eBay closes the case without a refund.

If you waited too long to open a case or to return the item or to ask eBay to step in, you may still have recourse from your payment method if you can provide tracking for your return.
