A day after the last estimated delivery date you can file an "item not received" case. The seller will have three business days to provide tracking that shows delivery. If not, you can ask eBay to step in after three business days. If you do not ask eBay to step in at some point, eBay will close the case without resolution, so be sure to ask eBay to step in before that happens if the seller has not refunded you or cooperated.
