How do I get my money back from a scam?

I bought a watch on ebay, but as it turns out the same pictures are listed elsewhere on a scam website. I need help in cancelling my order and getting a refund. I was covered by ebay's guarantee as well as paid by paypal.

You can not cancel your purchase. If the item does not arrive, then you can enter a not received claim.

After the last expected delivery date, but no more than 30 days after the last expected delivery date, go to your purchase history - select 'I haven't received it' and follow the prompts.
The seller has 3 business days to provide tracking that shows delivery, or a refund. If he doesn't, go to your case and click 'ask us to step in'.
