Help when ebays limited policy doesn't pan out

I bought something last year which didn't arrive. I went through all the steps with no response from the seller. I opened a resolution request through Ebay and the seller didn't respond. So, Ebay closed the case and I'm out $32. The seller is still doing business as usual and I would like to give buyers a warning. I really enjoy using Ebay and prefer it and recommend it over Amazon. Is there anything I can do?

There is no action you can take for a purchase made last year.

There are two reasons why eBay would have closed the case:

Tracking was provide by the seller showing the item was delivered.
You failed to go back to the case to ask eBay to step in when the seller didn't respond before the case timed out.

Which was it?
