Help, I'm being scammed
Dear eBay,
I have been a loyal customer for 27 years and have completed over 5,000 transactions as both a buyer and seller. I am writing regarding an issue with a recent purchase (Item #18-14423-36XXXX; Case #53779XXXX).
I purchased a Selkirk Boomstik pickleball paddle from this seller. Due to the prevalence of counterfeit paddles on eBay, I specifically asked the seller prior to purchase if the paddle was authentic, and they confirmed that it was. Please check the message back and forth with the seller to verify this.
Upon receiving the paddle, it initially appeared legitimate. However, the following day I compared it with a friend’s authentic Selkirk paddle at the court and noticed several differences. I then took it to Dick’s Sporting Goods to compare it with a verified retail version and found additional inconsistencies. Finally, I contacted Selkirk directly, provided photos, and spoke with a customer service representative who confirmed that the paddle I purchased is not authentic. I also posted picture proff this paddle was a fake, a clear violation of eBay's authentic guarantee policy.
I informed the seller of these findings. They responded that they may have unknowingly purchased a counterfeit paddle themselves and that they do not accept returns. I explained that regardless, the item was misrepresented, and eBay's policy prohibits the sale of counterfeit items as authentic. The seller continued to dispute the matter.
I then opened a case with eBay and was instructed to return the item, which I did promptly. The tracking number is 9302 2105 8470 0069 XXXX XX. The package has arrived at the seller’s post office; however, the seller has requested that it be held there, which appears to be an attempt to delay or avoid accepting delivery and issuing a refund.
At this point, I have fulfilled all the requirements requested by both the seller and eBay. I respectfully request that eBay step in, manually close the return as delivered, and issue the refund. I have been in an endless loop trying to speak with a live agent concerning this case. This is the message sent to eBay, what can be done? I can't get a hold or speak with a human, it seems like an endless loop and not getting anywhere. Should I do a charge back for my credit card? Is there a way to speak with a real person?
