Fraudulently sold Items
I purchased an item on eBay that was listed using the LEGO brand name and the Ghostbusters franchise name. However the item is not authentic Lego and is not an authentic Ghostbusters item. The item was fraudulently advertised. There is no LEGO branding on any pieces, the directions were in Korean with no Lego Branding and the name of the item was "Ghost Car" and not Ghostbusters. This is false advertising and fraud. How do I get my money back, get this seller kicked off eBay and save my child who opened this GARBAGE up on Christmas morning from losing faith in Santa?

Return the item for a refund.
Go to your purchase history - select 'return this item' , select 'does not match description' and follow the prompts. You can enter counterfeit item received in the comments.
The seller has 3 business days to provide a return shipping label, or a refund. If he doesn't, go to your case and click 'ask us to step in'.
To report the item, click on it. In the lower right, click the ?, then select report. Select problem with item, them IP infringement, then counterfeit item.

OP9 months agoThank you, I've done all that. Unfortunately, I purchased this in October for Christmas and my son opened on Christmas morning, after the 30 day return window. I reported the fraudulent/counterfeit item to eBay who did nothing and stated that I was past the 30 days so they would not enforce a refund. I contacted the seller who also said I would not get a refund and that they were using the "Lego" name and the "Ghostbusters" name as a generic term.

Call your credit card issuer and see if you can open a dispute through them - most cards give you 90 - 180 days buyer protection.
The seller is obviously ignorant of intellectual property laws, but only the owners of the IP can enforce claims against him.
Be sure to watch the return window, especially around the holidays - even amazon only gives you 60 days, 30 days the rest of the year.
