Why does EBAY always side with the seller? In fact EBAY said " out of stock or damaged". NOT TRUE. Seller still had merchandise, but posted a higher price. No I was nor affected so seller said " sorry, no have no more". I always thought EBAY looked into a complaint then proceeded.

Always? Are you basing this general statement on a single incident?

There's that "always" again. What complaint are you referring to? Disputes are typically handled through the computer program – which is heavily weighted in favor of the buyer – and rarely have human eyes laid on them until they reach the appeal stage, if even then.

This seller IS being punished by eBay by using the out of stock reason they get a DEFECT on their account. Just a few defects and their account is downgraded in search, they get charged a higher selling fee. If they still don't improve they are banned.
