Flagged for Counterfeit Items
Summary: ds.establishments is experiencing issues with items being flagged as counterfeit, despite providing evidence of authenticity. Despite appealing with receipts, bank statements, and offers to send inventory for verification, their appeals have been denied, resulting in a second 10-day probation from the platform. fashionsandbeauty4u advises against relisting, warning that further violations could lead to permanent suspension, and explains that eBay may be compelled by brand owners to take down listings to avoid legal action.
My best sellers keep getting Flagged as counterfeit Items when I get them directly from the store. every time I appeal with a receipt with time stamps and matching stamp dates on warranty card the appeal gets denied. I have even sent screen shots of bank statements that show the stores payment processor as a charge. Now that I have multiple of these violations my account is on a 10 day probation and is hidden to the public. I have even offered to send in all of my inventory to ebay for them to confirm its legitimacy but it seems like no one at ebay cares or is willing to help. This is the second 10 days suspension and it is killing my business. I don't know what else to do. please advise.

If this is your 2nd 10-day suspension for the same policy violation, you would be risking a permanent suspension by relisting.
I would say that 99.9% of Sellers who get counterfeit violations want to appeal. So it may not be that eBay doesn't care, but if a Brand owner orders eBay to take down a listing, eBay must comply or risk getting sued.
The only solution is to not relist.

OP1 month agoThank you for your reply! Its strange because I have maybe 8 other listings that are the same model but different styles that have 0 issue. Its only now and then where I will add a new style and it almost immediately gets flagged even though I'm using the same style listing across all of these models. My understanding is a brand cant just have a listing taken down without adhering to specific policy? Counterfeit items would fall under this but proving the legitimacy of the item would then warrant a relisting. All in all there has been an extreme lack of communication on ebays cs, ive been hung up on multiple times after looking to get an understanding on what exactly im being flagged for to avoid doing so in the future because based off all the policy i have read i am following the rules. Had a great conversation with cs yesterday, they told me they would relist the items and send specific reasons on why it was taken down. Lets see if they actually do it.
