It would seem the seller has stalled you from opening a dispute, with their messages, and it may now be too late to use ebay's Money Back Guarantee (MBG) because it has been 31 days since you received it, and the time frame for filing disputes through ebay has lapsed. If that has happened you will have to file through PayPal or your card provider to try to get a refund.
