false discription
I received an item that was falsely advertised in condition. I reached out to the seller who initially responded with "it was a mistake" I asked for partial refund and have not heard back. Its a month now. I tried reporting to eBay. Somehow the case was submitted that I didn't receive the item. I must have hit the wrong option is all I can figure. How do I contact eBay about the seller not answering and the false representation of the condition of the item?

Under normal circumstances you are protected by the eBay Money Back Guarantee for 30 days from the date of receipt: eBay Money Back Guarantee policy
You say it's been a month, has it been 30 days since you received the item? And yes, if you filed the claim you did not receive the item you could lose that case if the Seller uploads tracking that shows you received the item. So, that means you can still file an official return claim through eBay providing it's not too late.
Go to the item in your Purchase history and file a RETURN using the reason "Does not match pictures or description". eBay will issue you a pre-paid return shipping label regardless of the Seller's return policy. You return the item and the Seller will have 2 days to refund you. Failing that you go back to the claim and ask eBay to step in and force the refund.
If you are outside the 30 day window you will have to pursue a dispute with your funding source, PayPal, credit card, etc.
