False advertising

Question

I purchased an item that was advertised as â€œNEWâ€. When I receive the item I noticed the item was definitely used. It was dirty, had miscellaneous hairs and

fuzz on it and it shows imprint signs of wear. The the description states that there are no returns.
What should I do?

eBay's Money Back Guarantee overrides the sellers no return policy which just applies to buyer's remorse.

If you received an item that is not as described, you have up to 30 days to open a return using the option next to the transaction in your Purchase History. The seller will have 3 business days to provide a prepaid return shipping label or else refund. If he does neither, go back to the case on day 4 and use the option to ask eBay to step in. They will force the refund.

The Ebay Money Back Guarantee overrides a seller's "No returns" policy.

File a Return Request:

Go to your Purchase History, find the item, and under â€œMore actionsâ€ click on â€œReturn itemâ€ and select the reason for the return. â€œdoesn't match description". Attach a photo.
The seller will have 3 business days to either accept the return and provide a prepaid return shipping label OR refund without having you return the item.
If they don't do either, you can go back to your Return Request details 4 business days after you filed the Request and ask Ebay to step in.
