Empty envelope/package that was taped back up and delivered
I received a envelope/package that was delivered to me but had been torn open then resealed. The smartwatch I had ordered was clearly not inside. I took pictures of the empty envelope and immediately notified the vendor. The vendor replied back saying because the records show that the item was delivered they could not help me. I started a claim of not receiving the package which the vendor showed the delivery confirmation as record that they did their part.
I then filed a police report with the Los Angeles Police Department with the pictures of the empty envelope.
I spoke with eBay customer service and they said I needed to close that claim and start a "Item not received" claim. I did as I was asked and included the information from the LAPD police report.
I was informed that the vendor has sent me a return label and to send back the empty package. After a week, I contacted eBay and the vendor about not receiving the label. The vendor said the label was in the envelope. I said I did not open the package because I wanted to keep the packaging as I received it. The vendor said they would email me a new return label which I used to return the empty package.
All the while, both eBay and vendor knew that I had filed a police report that the item was stolen out of the package and I did not receive it. They also knew that I would only be sending back an empty package because that was how I got it.
Now that I shipped the empty package back, the vendor has claimed that I did not return the item and eBay closed the claim citing that I did not return the item.
I am at my wits end because of the run around even though I was absolutely clear about the situation.
As I see it, there is two possible ways this all went down;
1. The item had been taken out before it was given to the shipper (FedEx)
2. The shipper (FedEx) likely the driver, cut open the package, taped it back up, then delivered it.
I have never heard of the shipper doing anything like this before but becuase of the open communications with the vendor, I did not think the incident happened on the vendor's side. Now that the vendor claimed I didn't send back the item even though they knew of the situation, I am very suspicious of the vendor's possible nefarious activity.

Mentor2 years agoOpen a Return Request for an ITEM NOT AS DESCRIBED, missing item. Seller will pay for the return, if he wants it back, and/or refund. If no response by the fourth day, go back and ask ebay to step in. Do not close or let the case expire without doing this, if not resolved.
