Ebay rip off loophole
Ive been a loyal ebay customer or years. I ordered something for $350. The seller said they shipped it but didn't give a tracking # or even how they shipped it. I waited months for it to arrive. Finally i reported to ebay that it hadnt arrived. Ebay finally responded that my request was denied due to inactivity. I called ebay customer service and they said that i only have 30 days from the day the item was supposed to arrive to report the non arrival. The date that was supposed to arrive i knew had to be wrong and was just a wild guess being that there was no tracking #. That my ebay friends is a rip off. Ebay ripped me off.

I'm very sorry this happened, but we all have the same rules to follow when we buy on eBay. It's important to read eBay's Money Back Guarantee early so that we know what we have to do should there be any problem with our order.
Since you waited too long to take advantage of eBay's MBG ... I recommend you file a claim with PayPal or your credit card company. You should still have enough time for those. Good luck!
You asked in another post: From what you say, I have 30 days from the time it was supposed to arrive. I don't see that imaginary date anywhere on the order invoice or anywhere else. That time frame would have to be less than two weeks. Two weeks isn't long for a bug bulky item to go from Georgia to Alaska. I wonder where that imaginary date is?
The 'date' is called the Estimated Delivery Date (EDD). You will find it in the Order Details of your Purchase History. As soon as the EDD has passed ... we have 30 days to file an 'Item Not Received' dispute.
For an item coming from AK ... the greater transit distance is taken into account in creating the EDD. You should have realized something was wrong when you didn't receive a tracking number ... AND opened the claim before the deadline passed. You could have kept it open for almost 3 weeks if you thought the item might come at any time.
I always pay with a credit card through PayPal ... which gives me a few extra months to report an item 'undelivered' if I happen to miss the eBay deadline.

You have up to 30 calendar days after the estimated delivery date has passed to report that an item hasn't arrived.
The seller should respond within 3 business days to provide a delivery update, offer a replacement, or give you a refund. If you're getting a refund, it will go back to your original payment method. Refunds are typically available within 3-5 business days.
If the seller hasn't responded, or hasn't provided a resolution after 3 business days, you can ask us to step in. You have up to 21 business days from when you opened the original request.

Even if there was no shipping, if the estimated delivery date passes on the item, you are obligated to manually report the item was not received. If you did not, you waived your protections on the item.
To add to my POV on the matter, eBay is a middleman in the buying/selling process. It's not a loophole per se, but they cannot assume if you did not did not receive the package, so they depend on you to inform them of your own observation as you are said recipient.

OP2 years agoThank you for helping, I ordered the item May 13. I had a feeling the person wasn't going to ship it because they said they weren't but promised to cancel the order and return my money. I attempted to cancel the order but was rejected. Then I see that it was supposedly shipped May 17.
I waited until June 29 and reported that I hadn't recieved it.

·2 years agoI think you’re missing something here. The 30 days is not from when you ordered the item. It’s 30 days past the last estimated date of delivery, and you can open a case when it’s only one day late.
Yes, you’re past the eBay MBG date, but if you paid through PayPal, they allow 180 days to file an item not received case, or you can file a chargeback with your payment source (credit card or bank). You’re not out of options, but they have time limits to, so you should get right on that, and make sure you don’t let any dates they give run out.

The estimate is based on the sellers handling time and shipping choice.

OP2 years agoI've been using ebay for over 20 years and why didn't I know this loophole? There is no reason for them to make that rule other than avoiding having to deal with shipments that were never shipped. I'm seriously gonna avoid using ebay from now on. The money $300 bucks ebay saved will be pennies compared to what the amount of orders they are now losing out on. They should really think twice before losing my business. Amazon and Mercari have just taken your business. I guess they don't care but I'll spread the word to anyone who will listen. That's a greedy rip off policy.

OP2 years agoThe order I made was for something big. Since the seller didn't give a tracking # and this big item was supposedly being shipped to Anchorage, AK I figured it might take a long time to get to me. I waited till I was sure it wouldn't be showing up and sure it didn't get shipped somewhere else by mistake.
The item probably would have taken 3 weeks to arrive anyway so there really is only about a one week window when your doubt is solidified to file the forms ebay needs to start processing the lost item. Once again, that 30 day policy is a blatent loophole so ebay can avoid dealing with items that were never shipped but charged for. I've heard people say ebay will reimburse you.
I'll be going back and correcting all those people and tell them ebay ripped me off instead.
