Ebay ignores its own policy, wrongfuly blaming buyer about reports.
Hello,
I need to escalate this matter because eBay is not enforcing its own policies.
Recently, I received a message stating that the listing I reported (Item 146870469506 – RED Digital Cinema 300mm T2.8 PL lens) “did not violate eBay policy.†However, this decision was made by a customer service agent who clearly did not review the facts or eBay’s written rules.
This is a mistake, and it directly affects my unresolved refund request.
1. Misrepresentation of Item (eBay Item Not as Described Policy)
The listing used photos that do NOT match the item being sold.
The picture in the listing was a different lens than the one described.
RED Digital Cinema confirmed the photo appears suspicious and may not represent the actual item.
eBay policy states that using misleading, unrelated, or inaccurate photos is misrepresentation, which is a violation.
2. Seller Not Meeting Handling Time (eBay Seller Performance Policy)
After purchase, the seller admitted they cannot ship until December 8, which is:
After the handling time stated on the listing
After the maximum time allowed by eBay rules
When a seller admits they cannot meet the promised handling time, eBay must cancel for “seller non-performance.â€
Instead, I was told to wait until Wednesday — even though the seller has already stated they will not ship.
This contradicts eBay’s own written handling-time policy and places the burden on the buyer, not the seller.
3. eBay incorrectly closed the report
I notified eBay that the listing’s photos are inconsistent and that the seller is unable to ship on time.
The response I received was:
“We looked into your report and didn’t find the listing to be in violation.â€
This is incorrect and ignores the facts and eBay policy.
I am requesting the following:
Immediate cancellation of the order due to seller unable to ship violation.
Correction of the mistaken decision stating there was no listing violation.
Escalation to a supervisor or the Trust & Safety team if the agent cannot resolve this.
This is not a dispute or a preference — it is a clear policy violation.
Thank you.
