It is not necessary to have a person help you get a refund. You can use Ebay's Money Back Guarantee to file a Refund Request (item not received) or a Return Request (item not as described)
If the seller does not want the item back, all s/he has to do is reply to the return request with a full refund. I have only done that when it was too costly to ship an item back from New York to California for a damaged item.
I suggest sending photos of the damaged item, the outer packaging, the inner packaging, the shipping label. After refunding you, the seller can then file an insurance claim with the carrier, uploading the photos you sent.

The seller doesn't have a choice. They have to either accept the return and provide a shipping label or provide a refund.
If they don't do either one, you can go back to your Return Request and have Ebay step in to help you.
Also, you do not have to send the tracking number. If you use the return shipping label supplied, the tracking number is automatically entered.
If the seller is in a foreign country, they have to send you the funds to cover the return shipping. If they don't, you can have Ebay step in.
