eBay
I have contacted eBay regards the bellow with no support.
Any suggestions, the seller obviously refuses to accept a return and eBay continue to allow the seller to advertise the items.
Subject: Urgent Request for Resolution – Fraudulent Item Sold (Order 05‑13761‑63424)
Dear eBay Customers
I am contacting you regarding Reference ID: 2‑102125930759 and Order Number: 05‑13761‑63424, purchased from the seller jewellersemporium.
The item was advertised as 14K gold with certified lab‑grown diamonds. After only one month of normal wear, the ring began to change colour. I then had it assessed by a registered jeweller in Perth, Western Australia, who confirmed that:
The ring is not 14K gold, and
The stones are cubic zirconia, not lab‑grown diamonds as advertised.
This means the listing was false, misleading, and fraudulent, and it places other buyers at risk of being similarly misled. I have repeatedly contacted eBay about this issue, yet the listing remains unchanged and the matter unresolved.
Given the clear misrepresentation, I am requesting:
A refund, minus $50, which I consider a fair amount to cover the seller’s postage and minimal material value.
That the seller be required to update their item descriptions to meet Australian consumer standards—specifically stating that the items are 14K plated on base metal and that the stones are cubic zirconia.
I have already spoken with the ACCC – Consumer Protection, who advised me to attempt resolution with eBay before they proceed with an investigation. I am trying to resolve this amicably and prevent other buyers from being unfairly scammed.
I trust eBay will take this matter seriously and act promptly to address both my refund and the seller’s misleading listings.
Thank you for your attention. I look forward to your timely response.
Kind regards,
Jason

First, the item is not as described and you are protected by eBay for 30 days from the date of receipt and below is what you can do without involving the Seller and regardless of their return policy.
You are protected by the eBay Money Back Guarantee for 30 days from the date of receipt: eBay Money Back Guarantee policy
Go to the item in your Purchase history and file a RETURN using the reason "Does not match pictures or description". eBay will issue you a pre-paid return shipping label regardless of the Seller's return policy. You return the item and the Seller will have 2 days to refund you. Failing that you go back to the claim and ask eBay to step in and force the refund.
You can report a Seller here: Report an issue with a seller | eBay
If you are outside the 30 day window you will have to pursue a dispute with your funding source, PayPal, credit card, etc.
