e-bays return policy sucks

Question

i need help with an item ordered 11 months ago and never sent . They contacted me in december 2023 and said they were going to order one to ship me. now no contacted,ive try 3 times a week for 3 mounths and nothing. Ive been on hold with e-bay for 4 hours . they said its been over a year but its been 10 mounths . can anyone tell me what to do,im still on hold as I type I just want a 40.92 dollar refund, is that so hard.

Unfortunately, you have waited far too long to take action. eBay provides a Money Back Guarantee, but you must take action and open a case within 30 days of the estimated delivery date shown in your purchase history. Once 30 days have passed, eBay can no longer heip.
