Does the seller own the item being sold
Is it legal for a seller to post a listing for a pre-owned item that they do not actually own? I've seen listings mention that the seller will ship the item in the photos or an item that is equivalent to the item shown in the photos. However, every pre-owned item is different, and the meaning of equivalent is subjective.

Sellers need to post photos and descriptions of the exact item that is being sold. It's against eBay policy to list Item A, for example, and then ship Item B.
That is one of the reasons for the eBay 30-day Money Back Guarantee for Buyer Purchase Protection. If a Buyer receives something that is not as shown in the listing, they have up to 30 days from delivery to request a refund.
If you happen to come across listings that indicate the Seller might send an equivalent item, you can report that listing to eBay.
