What if you have seller that broke the 40 day rule lied about the delivery date .and just put down something was shipped just to get the funds knowing he was not going to ship the purchase out and stalled the buyer so it went past the 30 day fake delivery date I made a pre order purchase on January 24 the person selling new it wasn't going to ship till April 24th!!!

An almost 90 day estimated delivery time frame should have been a warning.
The rules for pre-order listings on ebay are they have to guarantee shipment within 40 days. That listing was a scam from the get go. Even if a seller were to follow the rules for Pre-sale/order listings, makers of the items sometimes run into issues with their release date, so you should always check their web site, before making a pre-sale purchase.
