Purchased iten, pay for it relized it was listed wrong ask for refund and selled agreed and will not refund because he says ebey server is not working as of last week.

Wait one day past the original estimated deliver date then go to your Purchase history and file a claim that you did not receive your item. Follow the claim instructions that will lead to an eventual refund.
